Various Types of Injury Questions Get Answers on ‘Moore Law’

Moore Law host and local TV journalist Deb Haas and attorney co-host Don Moore were joined by personal injury lawyer Penny Hendy from the Fort Wright, Kentucky-based firm of Schachter, Hendy & Johnson as they took viewer questions on the topic of “All About Injuries.” The show’s first caller, Tara in Cincinnati, demonstrated the importance of speaking with an attorney following an injury. She had spoken to her landlord about an issue with her garage door, and while someone was sent to inspect the problem, it was never fixed. The garage door later fell on her head.

Penny said it was important that Tara had spoken to her landlord about the issue beforehand. “What you have to keep in mind though is there’s a certain amount of time to pursue something, so you probably do need to talk with someone because the landlord can be responsible if they knew about the problem with the garage door and didn’t do anything about it,” Penny said. “Incidentally, if there was a person that came out and checked the garage door or looked at the garage door, they could have some liability too if they didn’t fix it properly or did something to the door that made it more dangerous to you and caused your injury.”

Don added, “In Ohio, there is a fairly strong landlord-tenant law, and specifically, landlord liability to provide a safe place.”

Other injury questions from Moore Law viewers included Tiffany in Cincinnati discussing a possible birth injury to her son as a result of medical malpractice, Traci in Cincinnati talking about issues she was having with her insurance company about the continuing care her chiropractor was recommending and Dwayne in Northern Kentucky asking what options he had after being hurt at work.
